These Terms govern your access as a user of the services, website, and applications ("Software", "System", "Platform", "Website", "Services", "Game", or "Gaming Services") offered by Gambyl.
Several definitions and meanings within these Terms are also discussed and defined within our Privacy Policy. The Software and Gaming Services to you by Gambyl, a company registered and operated in British Virgin Islands. The Company is regulated by and operates under the Kahnawake Gaming Commission regulations, having an allotted license issued by Kahnawake Gaming Commission. In the event of any complaints, claims, questions, and disputes concerning any outcome regarding the Services or any other activity performed by the Company, you should contact our customer support team at support@gambyl.com. Please note that our Services are not for use by persons under 18 years of age. No one under the age of 18 years, nor residents of either the United States or countries where the Services are prohibited, is permitted to participate in the activities, games, Services, and Gaming Services. If it comes to the Company's attention that a registered user is a person under 18 years of age or is otherwise not permitted to use the Services, the Company will cancel that user's account.
Some countries may prohibit or limit some or all forms of gambling available on this site. You are responsible for ensuring that you are familiar with your country's laws relating to gambling (and, if dissimilar, the laws of the country in which you are playing) and that you do not infringe on these regulations. TERMS OF SERVICE AGREEMENT: The Company permits you to use its Services, subject to the terms of this agreement. By registering and opening an account, you certify that you agree to be bound by the terms of this agreement. If you do not wish to be bound by these terms, you must not register to open an account, and you will be unable to access or use the Services. The terms of this agreement may be changed or updated at any time by us without any notice to you. Your continued access to, and use of, the Services will mean that you agree to be bound by the most current version of this agreement.
REGISTRATION: To use Company's Services, you must first open an account by entering required details, such as a valid email address and correctly formatted password, or the equivalent information via a Social Media Login. To deposit funds to your account, you must enter your first and last name, address, telephone number, and other required information. You agree to provide only accurate and current information, and you further agree to update this information as necessary to keep it true and up-to-date. It is strictly forbidden to have more than one active account at Gambyl at any one time.
The Company reserves the right to suspend, modify, remove and/or add any Game at its sole discretion with immediate effect and without notice. Gambyl will not be liable for any such action.
USE OF SERVICES: You agree to keep your account details confidential and not allow anyone else to use or have access to it. Any participation in the service is at your discretion and risk. You are only authorized to wager for your entertainment; thus, any commercial use is forbidden. By playing at Gambyl, you agree that you do not find the Services or other aspects of the company offensive, objectionable, unfair, or indecent. You agree that you are responsible for verifying and abiding by the laws governing gambling in the place where you use the website.
BOTS: It is strictly forbidden to use any automated software or computer systems (Bots) to play at Gambyl, including the action of sending information from your device to another device where such software or system is active. Bots or any software designed to play automatically at online sports betting sites is not allowed. Also forbidden is the use of any software during the game that is designed to track and display the actions of the other players in the system or any system or service to transfer funds to or from a player's account to their account at any other site or the deliberate "dumping" of funds between any accounts. Usage of such methods will result in the closing of your account and be subject to confiscation of your winnings and funds.
Gambyl reserves the right to publicize information of any such documented abuse, including your personal information. DEPOSITS: To use the Services, you must deposit real money into your account by the methods provided to you by Gambyl. All funds deposited will be paid, tracked, and maintained in cryptocurrencies or United States Dollars and will not bear any interest. Any and all fees levied by payment processors are your responsibility. Please make sure you are playing at your skill level when gaming at Gambyl.
PAYOUTS: You will be able to monitor the balance of funds you have available, plus or minus any accumulated winnings or losses from placing wagers on the service, less any amounts previously withdrawn by you or amounts forfeited or reclaimed by the Company. All amounts paid out are subject to the transaction limits and processing fees of Gambyl. These payout limits and fees may change from time to time at the Company's sole discretion or by you in the case of user-defined limits. If funds cannot be remitted to the original payment method, the user may have to make a small deposit using another payment method; the relevant checks will be carried out. Once verified, the withdrawal will be processed.
ACCOUNT ABANDONMENT: If no transaction has been recorded on a Player's account for a period of eighteen (18) months (4), Gambyl reserves the right to close the account and remit the balance using the last known details of the player.
SECURITY CHECKS: Gambyl reserves the right to verify your identity and the fidelity of the information you have supplied by making various security and ID checks. Any failure or refusal to comply with a request from Gambyl may result in the forfeiture of your account.
OPERATION OF ACCOUNTS: During the term of your account, there may be circumstances that require changes to your account. I. Succession: In the event of your death or permanent incapacity, Gambyl requires a copy of the death certificate or a registered medical physician's statement and documentation of beneficiary rights as proof of your successor's or guardian's (jointly referred to as "Beneficiaries") entitlement. In this event, any of your income rights and/or the value of your account may be passed to your Beneficiaries. Your Beneficiaries must submit a written application supported by the necessary documentation, including a death certificate or registered medical physician's statement, and documentation of beneficiary rights for consideration by the Company.
Approval of this application shall not be unreasonably withheld. Transfers will only be approved if the Beneficiaries agree to assume your account responsibilities and obligations as outlined in these Terms & Conditions. Suppose a Beneficiary is not permitted to hold an account. In that case, the Beneficiary will be entitled to transfer your interest in the account to a third party entitled to hold a Gambyl account. II. Self-Exclusion: If you believe you have a gambling problem or wish to take an enforced break from gaming, the Company gives you the power to temporarily or permanently exclude yourself from playing at the site. You may request to be excluded from entering or using the Services for various reasons and may do so at any time by sending a request to support@Gambyl.com. If you choose to exclude yourself permanently, your request will be honoured, your account closed, and you will not be permitted to return to Gambyl any time in the future. If you choose to request a temporary exclusion, your request will be honoured, and you may apply for reinstatement at a later date, as per your set instructions. You can select a two-day, one-month, or six-month self-exclusion.
Upon the expiration of the requested exclusion period, your account will be unlocked automatically. III. Limiting your Personal Expenditure: Gambyl provides tools to help you control your gaming. You can establish limits on the amount you deposit over a given period, be it daily, weekly, or monthly. Requests to tighten your limits will take effect immediately, whereas requests to loosen those limits will be addressed within 24 hours. You can set these limits when you first create your account, or you can change them anytime after that by visiting your Gambyl Account Settings screen. From this page, click on the "Limits" button, and a page will be displayed where you can set your daily, weekly, and monthly spending limits. IV. Suspensions and Termination of Account: Gambyl reserves the right, in its discretion, and in relation to your account and any related payment service provider account, any accounts you may have with other sites and/or casinos and/or Services owned or operated by or on behalf of the Company to terminate this agreement, withhold your account balance, suspend your account and recover from such account the amount of any affected payout, bonuses and winnings if: you breach any of the Terms of Service of this agreement; or provide any false or misleading information to the Company; or partake in fraudulent, inappropriate or offensive behavior against the Company or you have 'charged back' or denied any of the purchases or deposits that you made to your account; or are involved in an activity which may be deemed contrary to accepted standards of fair dealing, in breach of laws applicable in your jurisdiction and/or contrary to the interests of Gambyl or injurious to the Company's reputation.
Some countries prohibit or limit some forms of gambling or gambling itself available on this site. You agree that you are familiar with your country's laws relating to gambling and that your use of the website does not infringe any laws. However, the Company's actions if you engage in such conduct can include but are not limited to warnings, temporary suspension of Gambyl Services, and temporary suspension of your Gambyl account. The termination of your Gambyl account will only be considered in the case of the most severe violations or, as a result of multiple violations and, where possible, only after repeated communication with you. In the event of the termination of your account, you agree:
1. Your right to make any representations regarding Gambyl in any way whatsoever is immediately revoked;
2. Your right to use the Gambyl Services, your User Account and Password are immediately revoked;
3. Your right to any present or future entitlements you might otherwise have or have had arising from the Company or your use of the Gambyl Services, as of the date of termination is revoked and ;
4. All other rights under these Terms of Service are terminated. Gambyl will endeavour to notify you of any minor breach of these Terms of Service. The Company becomes aware and will afford you a reasonable time to rectify that breach and show cause why your account should not be terminated. You will be notified of the Company's decision and the reasons for its decision by email.
DISCLOSURE TO THIRD PARTIES: You agree to keep your account and related information secret and confidential and not allow anyone else to use it. If you intentionally or unintentionally, directly or indirectly, disclose email and/or password to another person, and such disclosure results in a third party participating in the Gambyl Service using your email and password, such participation will be invalid. You will not be refunded any resulting losses at Gambyl, regardless of whether or not the third party had your consent. The Company shall not be required to maintain email or passwords if you misplace, forget or lose this data or are otherwise unable to enter Gambyl because of anything other than the Company's error. If you misplace, forget, or lose your Account name, username, or password due to anything other than software's error, Gambyl shall not be liable.
INDEMNIFICATION: You agree to indemnify, defend and hold harmless Gambyl and its parents, subsidiaries, affiliates, officers, directors, shareholders, employees, agents, licensors, and partners from any claims, losses, liabilities, demands, damages, costs, or expenses (including reasonable attorney's fees), arising from or asserted by any third party relating in any way to (i) your use of the Company's Services, or any other product, service or promotion offered to you by the Company; (ii) any claim of infringement of third party intellectual property rights; (iii) uploading, posting, emailing, reproducing, transmitting or otherwise distributing any content or other materials by you; or (iv) the breach of any of these Terms of Service by you or any users of your account with Gambyl. Gambyl reserves the right to assume the exclusive defence and control of any matter subject to indemnification by you, which shall not excuse your indemnity obligations.
ABUSIVE OR OFFENSIVE LANGUAGE: Abusive or offensive language will not be tolerated in the system or with Gambyl's staff. Any violation of this policy will result in a suspension of playing privileges or other action required by the Company to ensure compliance. You are not permitted to use inappropriate or offensive language in connection with your user name and/or player ID, which includes, but is not limited to, profane, sexist, or racist language.
Gambyl reserves the right to make changes to any User's name or player ID that violates this policy and to take any steps it deems appropriate, up to and including closing an account, you create an account with an offensive username and/or player ID or change your existing user name/ID to an offensive one you may have your user name/ID changed and locked. The ability to change your user name and/or player ID will be revoked. You may still be permitted to change your name/ID once per month, but you will be required to contact support to do so.
DISCLOSURE OF FRAUDULENT ACTIVITIES: Gambyl has a zero-tolerance policy towards inappropriate play and fraudulent activity. If, at the Company's sole determination, you are found to have cheated or attempted to defraud Gambyl in any way, including but not limited to game manipulation, funds dumping, transfers or payment fraud, or if you make untrue and/or malicious comments concerning the Company's operation in any media or forum, the Company reserves the right to publicize your actions as well as to circulate this information to other online gaming sites, banks, credit card companies, and appropriate agencies. Further, the Company may close any accounts and forfeit the account balance at Gambyl or any other Gambyl related website and/or business.
The Company reserves the right to void and withhold any or all winnings made by any person or group of persons where we have reasonable grounds to believe that the said person or group of persons is acting or has acted in liaison in an attempt to defraud or damage the Company.
SECURITY REVIEW: To maintain the level of security and integrity in the system, Gambyl reserves the right to conduct a security review at any time to verify the identity, age, and registration data provided by you, to verify your Use of the Services, including but not limited to your compliance with these Conditions and the policies of Gambyl and your financial transactions carried out via the Services for potential breach of these Conditions and applicable law. As such, you authorize our agents and us to make any inquiries of you, and for us to use and disclose to any third party, we consider necessary to validate the information you provide to us or should provide to us in accordance with these Conditions, including but not limited to, ordering a credit report and/or otherwise verifying the information against third party databases. In addition, to facilitate the security reviews, you agree to provide such information or documentation as the Company at its discretion may request.
COMPLAINTS AND NOTICES: In the event you have any complaints, claims or disputes with regard to any outcome regarding the Services or any activity provided by Gambyl, you must submit your complaint to the Company in writing as soon as is reasonably practical following the date of the original transaction to which the claim or dispute refers. Complaints may be submitted by email to support@gambyl.com. Any notice we give to you will be sent to the email address that you provide when you register your account. It is your responsibility to provide us with information about any changes to this address.
COMPENSATION: You agree that you will only use the Services provided by Gambyl in accordance with the Terms and Conditions set out in this schedule. Any breach of these conditions which results in the Company incurring any losses or costs will render you liable to compensate Gambyl for any such losses or costs in their entirety.
COPYRIGHT AND TRADEMARKS: The logos carried about and belonging to Gambyl, custom graphics, and button icons are trade names, service marks, or trademarks of Gambyl or its affiliates if any. All other trademarks, trade names, and service marks on the site are the property of their respective owners (the "Other Marks"). Without the Company's prior permission or the prior permission of the owners of the Other Marks, you agree not to display or use in any manner the Company's Marks or the Other Marks.
GOVERNING LAW AND DISPUTES: Kahnawake Jurisdiction for Disputes: These conditions shall be governed and construed in accordance with the laws of Kahnawake. You agree to submit for the benefit of the Company, to the exclusive jurisdiction of Kahnawake Gaming Commission and the Courts of Kahnawake for settlement of any disputes or matters arising out of or concerning these Conditions or their enforceability. Suppose any part of these Conditions is found to be invalid, illegal or unenforceable in any respect. In that case, it will not affect the validity of the remainder of the Conditions, which shall remain valid and enforceable according to their terms. Kahnawake Gaming Commission Reporting: Gambyl may be obliged in accordance with the Act to provide regulatory disclosures of personal information to the authority including, inter-alia, details of players breaching these terms and conditions and especially: players gambling or attempting to gamble when underage or suspected of being underage; players engaged in suspicious transactions or suspected to be engaging in money laundering or fraud; players colluding or suspected of collusion; players using robots or modifying the software or suspected of doing so; suspicious use of the Chat facilities; players who have left their accounts dormant; players who register a dispute with the authority. Account Disputes: Where there is any dispute concerning a player's account, Gambyl reserves the right to suspend the player's account until a resolution is reached. To the fullest extent permitted by applicable law, Gambyl, its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, licensors, and agents, now expressly disclaim any representations and warranties of every kind, whether express or implied, regarding the Services, its content, and any information or other materials provided by Gambyl in connection with use of the Services, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement and those warranties arising by law, statute, usage of trade, or course of leading. Gambyl makes no warranty. the Services will meet your requirements; the Services will be uninterrupted, timely, accurate or error-free; or The servers that make Gambyl's service available are free of viruses or other harmful components, and any errors in our software will be corrected. The security mechanisms incorporated into the Services have inherent limitations. You acknowledge and agree that any material and/or data downloaded or otherwise obtained through the use of Gambyl Services is done at your discretion and risk and that you will be solely responsible for any damages to your computer system and any other property item or loss of data that results from any such activity. The disclaimers contained in this paragraph are a material part of our agreement to provide the site to you. Some jurisdictions do not allow the exclusion of implied warranties. Accordingly, some of the above exclusions may not apply to you.
LIMITATIONS OF LIABILITY: To the fullest extent permitted by applicable law, under no circumstances, shall Gambyl or its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, agents, partners, or licensors, be liable for any injury, loss, claim, damage or any indirect, incidental, special, punitive or consequential damages of any kind, or any damages whatsoever, including, without limitation, damages for loss of income, use data, goodwill or other intangibles, whether or not advised of the possibility of such damages, and on any theory of liability (including negligence), arising out of or in connection with: (1) Your use or inability to use the Services; (2) Goods, data, or Services received through or advertised on the Gambyl site; (3) Information received through the Gambyl site; (4) Mistakes, omissions, interruptions, suspension, termination, deletion of files or email, damages to computer system or equipment or other property, unauthorized access to or alternation of your transmissions or data, errors, defects, viruses, delays in operation or transmission, or any failure of performance with respect to the site, including, without limitation, those that result from acts of god, communication failures, theft, destruction, or unauthorized access to Gambyl records, programs or Services; (5) Statements or conduct of any third party on the Gambyl service; or (6) Any other matter relating to the Gambyl service. If you are dissatisfied with the service or the content available thereon or with any of these terms of service, your only remedy is to discontinue using these Services. The liability limitations are a material part of our agreement to provide the site to you. Notwithstanding the preceding, if Gambyl or its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, agents, partners or licensors should be found liable for any loss or damage which arises out of or is in any way connected to the site, the liability of the Company, or its officers, directors, employees, shareholders, parents, subsidiaries, affiliates, agents, partners or licensors shall in no event exceed, in the aggregate, $50.00 or equivalent amount in other currency. LOSS OR CORRUPTION OF DATA AND DAMAGE TO COMPUTER OR MOBILE PHONE DEVICES: Gambyl shall not be responsible or liable for any loss or corruption of data or content that you may experience while using the service or otherwise. This includes, without limitation, the loss or corruption of data or content resulting from system or server "crashes" or outages, or other power outages; damage caused by viruses, worms, or security breaches, file corruption; and any other cause. The Company assumes no responsibility, and shall not be liable for, any damages to or viruses that may infect your computer equipment or other property on account of your access to, or use of, Gambyl's Services.
MISCELLANEOUS: These Terms of Service constitute the entire agreement between you and Gambyl and govern your use of the Services, superseding any prior agreements, if any, between you and the Company, including, without limitation, any previous versions of these Terms of Service
A. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Gambyl due to the Terms of Service or use of the Site.
B. The failure of the Company to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver or relinquishment of such right or provision or any other right or provision.
C. If any part of the Terms of Service is determined to be invalid or unenforceable under applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms of Service shall continue in effect.
VIOLATIONS: Please report any violations of the Terms of Service to support@Gambyl.com. We reserve the right to report any criminal or suspicious activity to the appropriate law enforcement agency. Gambyl reserves the right to monitor Your account activities and notify You if the Company believes You may have gambling problems. However, the Company makes no warranties about its ability to identify and help You with gambling problems.
